Familiars Unleashed — Terms of Use

The short version. Be 13 or older. Photograph your own pet, kindly, and never a person. You keep your photos; you let us turn them into game cards and show those cards to the players you battle. Battles are decided by fixed rules, not by AI and not by us. The game is fiction, it is still in testing, and it can change.

1. Who these terms are between

These Terms of Use (“Terms”) are an agreement between you and Surre's Creative Reality, LLC, a Tennessee limited liability company (“we”, “us”), about the Familiars Unleashed app, including TestFlight builds, and the challenge links, battle records, and web pages it creates (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

The app is licensed to you, not sold, under Apple's standard Licensed Application End User License Agreement. These Terms add the rules about accounts, your content, conduct, battles, and purchases; where the two overlap, these Terms govern your relationship with us and Apple's agreement governs the app license. Apple is not responsible for the Service or its content, and Apple and its subsidiaries are third-party beneficiaries of these Terms, entitled to enforce them against you.

3. Your account

You sign in with Sign in with Apple. Keep your Apple ID secure; everything done from your account is your responsibility until you tell us it has been compromised. One person, one account. You can delete your account from inside the app at any time, which permanently removes your familiars, photos, and portraits as the Privacy Policy describes. We may suspend or close an account that breaks these Terms, and we will tell you why unless the law prevents it.

4. Your content, and what you let us do with it

You own what you bring. Your pet photos, the names you type, and any other content you provide (“Your Content”) stay yours.

You give us a license to run the game with it. So that the Service can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, analyze, adapt, and create derivative works from Your Content — including generating a card and a stylized portrait from your pet's photo — and to display and distribute the resulting card, name, portrait, and battle records within the Service: to the players you battle, in Today's Standings, in battle records and the challenge or share links that point to them, and to operate, moderate, secure, and improve the Service. Your original photo is shown only to you and is never displayed to other players or on share records. This license lasts as long as Your Content is in the Service. After you delete a familiar or your account, it continues only for the frozen battle records the other player already holds, which are no longer linked to any account.

You promise you have the right to give that license. You confirm that each photo you upload is your own pet, one you have the owner's permission to photograph and use in the game, or a wild animal photographed safely from a distance as our Pet & Photo Safety page describes; that it shows no identifiable person; and that nothing in Your Content infringes anyone's rights or breaks the rules in section 6.

The generated card is ours to license back to you. The card's stats, abilities, flavor text, portrait, battle stories, and everything else the Service generates or authors (“Game Content”) belong to us or our licensors. You may use the cards, portraits, and battle records made for your own familiars for personal, non-commercial purposes, including sharing them, for as long as these Terms allow you to use the Service. Game Content is fiction created in part by AI from your photo; it is not a statement about your real pet.

Read our Pet & Photo Safety page before your first photo. If we see a real animal at risk in a photo we may report it to the appropriate authorities.

7. Reports, blocks, and moderation

You can report a familiar or a battle and block a player from inside the app. A person reviews every report. We may remove content, suspend accounts, or take other action we think is proportionate, and we may keep records of reports to enforce these Terms. We do not review every card before it is shown, so you may occasionally see content that breaks these rules; please report it.

8. Purchases

The Service currently sells nothing. If we add in-app purchases — for example additional portrait renders — they will be sold through Apple, under Apple's payment and refund terms, and described in the app before you buy. Purchased items are licenses to use features within the Service, have no cash value, and are not transferable. Free allowances, such as a number of free portrait renders, are limits we set and may change.

9. Testing, availability, and changes

Familiars Unleashed is in testing. Builds distributed through TestFlight are also subject to Apple's TestFlight terms. Features may change, break, or disappear; data from test builds may be reset; and we may modify, suspend, or discontinue the Service or any part of it. We will give reasonable notice of material changes to these Terms by updating the version and date above and, for changes that matter, inside the app. Continuing to use the Service after a change means you accept it.

10. Ending things

You may stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we shut the Service down. Sections 4 (for frozen battle records), 11, 12, 13, and 14 survive.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. Game Content is fiction; it is not veterinary, behavioral, breeding, or care advice about any real animal. We do not promise the Service will be uninterrupted, error-free, or that generated content will be accurate or to your taste.

12. Limitation of liability

To the fullest extent the law allows, we and our officers, members, employees, and providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from or related to the Service, and our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim and fifty US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.

13. Your responsibility to us

If someone brings a claim against us because of Your Content or your breach of these Terms, you agree to defend us against it and to cover the costs and damages we reasonably incur, provided we tell you promptly and let you control the defense with our reasonable cooperation.

14. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee and the United States, without regard to conflict-of-law rules. Any dispute that we cannot resolve together will be brought in the state or federal courts located in Tennessee, and you consent to their jurisdiction, except that either of us may seek relief in small-claims court or an injunction to protect intellectual property anywhere. Nothing here limits rights you have as a consumer under the mandatory laws of the place you live.

15. General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If part of them is unenforceable the rest stands. Our not enforcing a term is not a waiver. You may not transfer these Terms; we may transfer them to a successor to the Service. “Familiars Unleashed” and the game's names, art styles, and characters are our trademarks and works; nothing here grants you rights in them beyond those stated in section 4.
